A Primer for Securing a BMEC Authorization.

Manufacturers aiming to sell their products in Ontario, Canada, often encounter regulatory requirements that mandate them to obtain specific authorizations.

 

This article provides a high-level overview of the application process for a Building Materials Evaluation Commission (BMEC) authorization, emphasizing the importance of understanding the Ontario Building Code, the role of a Professional Engineer, and the procedural steps involved in applying for and securing a BMEC authorization.

 

There are several scenarios in which getting a BMEC authorization is the fastest route to the Ontario market. A common one is when an innovative product is not yet covered by the Ontario Building Code. In this case, a manufacturer may need the authorization of every Ontario municipality to distribute the product. Alternatively, the manufacturer can obtain a BMEC authorization to distribute its product in the entire province. Authorizations are valid for five years. 

 

Anyone seeking authorization from the BMEC should understand the Ontario Building Code and how it applies to the product in question. This insight will guide the application process.

 

An application for a BMEC authorization requires the signature of a Professional Engineer (P.Eng.) licensed to practice in the Province of Ontario. The P.Eng. signing the application must be registered with Professional Engineers Ontario(PEO) and have a certificate of authorization to provide services to the public.

 

The application form is available from the BMEC. Prior to filling out the form, the applicant must collect all the relevant information and documentation. Listing certificates, test reports, quality control manuals, installation manuals, product drawings, and approvals from other jurisdictions are all necessary documents to support the application.

 

It is good practice to coordinate with the BMEC to identify the optimal time to submit your application. Typically, the application must be submitted six weeks before the next meeting of the Commission. The BMEC Code Advisory and Services Group needs this time to convene internally to discuss the application prior to the meeting. The applicant receives the Group's opinion before the next stage — the meeting.

 

At the meeting, the applicant presents the application, and the committee will ask questions. Following the meeting, the BMEC forms a subgroup to review the application again, ask additional questions, and make a recommendation to the BMEC. This stage can take 2 to 4 months, during which time the Commission may reach out to the applicant for clarifications and, once approved, share the draft authorization for review and comment.

 

Finally, the formal decision is made at the following meeting of the Commission. The authorization can be renewed for another five-year period, repeating the entire process.

 

To conclude, navigating the regulatory landscape to secure BMEC authorization is essential for manufacturers looking to introduce innovative products to the Ontario market. The provincial standards are quite rigorous, and the review process requires careful preparation on the part of the applicant. Plan early to align with the BMEC meeting schedule and gain access to the Ontario market of building materials.
